SMS Program Overview: ATA Enterprises INC offers an optional SMS text messaging service to provide account alerts, transaction notifications, security updates, and promotional messages. Participation in this program is voluntary and requires your express consent.
Automated Messages: By opting in to receive SMS messages, you agree that we may send automated text messages to the mobile phone number you provide using an automatic telephone dialing system (ATDS). These messages may include account alerts, security notifications, transaction confirmations, and marketing communications.
Message Frequency: Message frequency may vary based on your account activity and the types of alerts you have enabled. You may receive multiple messages per day during periods of high account activity.
Message and Data Rates: Message and data rates may apply based on your mobile service plan. Standard messaging rates from your wireless carrier will apply to all SMS messages sent and received. Please consult your carrier for specific rate information.
Supported Carriers: The SMS service is available on most major U.S. wireless carriers. Check with your carrier to confirm SMS service availability and compatibility.
Opt-Out at Any Time: You may opt out of receiving SMS messages at any time by replying STOP to any message from ATA Enterprises INC. You will receive one final confirmation message acknowledging your opt-out request. To resume receiving messages, reply START or update your preferences in your account settings.

Not a Condition of Service: Consent to receive SMS messages is NOT a condition of opening or maintaining a bank account, using our banking services, or purchasing any products from ATA Enterprises INC. You may decline SMS communications and still access all banking services and features.
Mobile Number Changes: You are responsible for notifying us if your mobile phone number changes. Failure to update your contact information may result in SMS messages being sent to a non-working number or to a third party.
Privacy and Data Security: Your mobile phone number and SMS communication preferences are subject to our Privacy Policy. We do not sell, rent, or share your mobile number with third parties for their marketing purposes.
All content, features, and functionality of the Services, including but not limited to text, graphics, logos, icons, images, and software, are the exclusive property of ATA Enterprises INC and are protected by United States and international copyright, trademark, and other intellectual property laws.
You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Services without our prior written consent.

To the fullest extent permitted by law, ATA Enterprises INC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

Any dispute, controversy, or claim arising out of or relating to these Terms or the Services shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in Dover, Delaware, and shall be governed by Delaware law.
You agree to waive your right to a jury trial and to participate in a class action lawsuit.
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
We reserve the right to modify or replace these Terms at any time at our sole discretion. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

We may terminate or suspend your account and access to the Services immediately, without prior notice or liability, for any reason, including without limitation if you breach these Terms. Upon termination, your right to use the Services will immediately cease.
You may terminate your account at any time by contacting us and following the account closure procedures. All provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.
These Terms, together with our Privacy Policy and any other legal notices published by us on the Services, constitute the entire agreement between you and ATA Enterprises INC concerning the Services and supersede all prior agreements and understandings, whether written or oral.
